A secondary school in Wicklow has taken legal action against planning approval granted for the opening of a McDonald's fast food restaurant less than 100 meters from its doors.

Temple Carraig secondary school in Greystones, Co Wicklow, believe that the chain restaurant specifically chose the location of its drive-through restaurant because of its proximity to three schools who have over 1,800 students enrolled.

The Irish Examiner reports that in challenging the planning permission the school are alleging that "The decision by An Bord Pleanála to grant approval for the restaurant fails to take account of national policy concerning the health of children and to reduce childhood obesity. "

The other two schools located close to the proposed McDonals restaurant are Gaelscoil na gCloch Liath and Greystones Educate Together.

An appeal against the granting of the planning permission was rejected by AnBord Pleanála.
Mr Justice Richard Humphreys has granted leave for judicial review of the September 30, 2015, decision by the board to grant permission for a development comprising the McDonald’s restaurant, a health and fitness studio and a commercial unit at the Blacklion Neighbourhood Centre. If the judicial appeal is favourable to the school, the appeal may have to be re-heard. If the planning permission is eventually rejected, McDonald’s may be able to apply again.
